1. About Texas Commercial Plans

Texas Commercial Plans ("TxCP," "we," "us," or "our") operates the website at texascommercialplans.com and provides commercial electricity rate data for the Texas deregulated market. We collect, normalize, and publish rate information from publicly available sources. We are not a Retail Electric Provider (REP), energy broker, or aggregator as defined under Texas Utilities Code § 39.351 or § 39.352, and we do not hold any certification or registration from the Public Utility Commission of Texas (PUCT).

2. Acceptance of Terms

By accessing or using the TxCP website, purchasing data products, or subscribing to our services, you agree to be bound by these Terms of Service. If you do not agree, do not use the site or purchase any data product. These terms constitute a binding agreement between you and TxCP.

3. Data Accuracy and Disclaimer

All data provided by TxCP is for informational purposes only and is provided "as is" without warranty of any kind, express or implied.

Rate data is aggregated from publicly available sources, including REP websites and third-party data services. While we update our data twice daily and make reasonable efforts to ensure accuracy, we do not guarantee that any rate, plan detail, fee, contract term, or other information displayed on this site is accurate, complete, current, or error-free. Commercial electricity rates are subject to change at any time without notice by the issuing REP.

You must independently verify all rate information directly with the applicable REP before making any purchasing, procurement, or business decision. TxCP is not responsible for any discrepancy between the data we display and the actual rates, terms, or conditions offered by any REP.

We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the service will be uninterrupted, timely, secure, or error-free.

4. Not Energy Advice or Brokerage

TxCP does not provide energy consulting, procurement advice, or brokerage services. We do not recommend, endorse, or sell electricity plans. We do not act as an agent or representative for any REP, Transmission and Distribution Utility (TDU), or end-use customer.

Nothing on this site should be construed as a recommendation to purchase, switch to, or enter into any electricity service agreement. You are solely responsible for evaluating plans, reading Electricity Facts Labels (EFLs), and making your own procurement decisions.

5. Use of Data

Purchasing a data product (e.g., the $10 spreadsheet download) or subscribing to a data plan grants you a limited, non-exclusive, non-transferable license to use the data for your own internal business purposes.

• You may use the data for internal analysis, procurement evaluation, competitive intelligence, and client advisory work.
• You may not redistribute, resell, sublicense, or publicly republish TxCP data in raw or substantially similar form without prior written consent.
• You may not use automated means (bots, scrapers, crawlers) to access or extract data from the site or API beyond the limits of your subscription tier.

6. Purchases and Payments

Payments are processed securely through Stripe. All purchases are final. Due to the nature of digital data products (instant access upon payment), we do not offer refunds. If you experience a technical issue preventing you from accessing your purchased data, contact us and we will resolve it promptly.

Subscription pricing, if and when offered, will be billed at the frequency stated at the time of purchase. You may cancel a subscription at any time; access continues through the end of the paid billing period.

7. Limitation of Liability

To the maximum extent permitted by applicable law, TxCP, its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or procurement savings, arising from or related to your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to the service shall not exceed the total amount you paid to TxCP in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless TxCP, its owner, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your use of the data, your violation of these Terms, or your violation of any rights of a third party.

9. Intellectual Property

The TxCP website, its design, branding, and the compiled and normalized dataset are the intellectual property of TxCP. The underlying rate data originates from REPs and public sources; our compilation, normalization, and presentation of that data constitute original work. You may not copy, reproduce, or create derivative works from the site or its content except as permitted under Section 5.

10. Third-Party Links and Services

The site may contain links to REP websites, regulatory resources, or other third-party sites. These links are provided for convenience and do not imply endorsement. We are not responsible for the content, accuracy, or practices of any third-party site.

11. Regulatory Compliance

TxCP provides data services only. Users are solely responsible for their own compliance with all applicable laws and regulations, including but not limited to PUCT Substantive Rules, the Texas Utilities Code, and the Texas Deceptive Trade Practices Act (Tex. Bus. & Com. Code § 17.46). If you are a licensed broker, aggregator, or REP using this data, you remain responsible for meeting all regulatory obligations applicable to your activities.

12. Modifications to Terms

We may update these Terms of Service at any time. Changes take effect when posted to this page. Your continued use of the service after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.
